TERMS AND CONDITIONS OF SERVICE FOR DONNA WILLIAMS WELL-BEING AND EMERGENCYOGA PRODUCTS

The contractual parties

These Terms and Conditions of Service apply to all contractual relationships between Donna Williams Wellbeing, operating as Emergencyoga, referred to throughout this document as the Organizer, and its clients, referred to throughout this document as the Participant.

Services

The Organizer agrees to deliver the retreat as per the published description, which may include accommodation, meals, workshops, yoga, meditation, breathwork, sound healing, guided movement practices, mentorship, excursions, and/or group activities.

The Organizer reserves the right to make reasonable changes to the retreat program, venue, schedule, or facilitators if necessary. Any such changes will not materially alter the overall quality or purpose of the retreat.

Services not explicitly listed in the retreat description are not included in the package. Extras such as travel, travel and medical insurance, spa treatments, additional excursions, meals not specified, or personal expenses are the responsibility of the Participant.

Booking

A retreat booking is confirmed once the Participant submits the booking form and pays the required deposit.

Bookings are personal and cannot be transferred without the Organizer’s written consent.

The Organizer reserves the right to decline a booking in cases where participants do not meet or adhere to the retreat requirements, or where the retreat itself is not able to meet the requirements of the participant, (as an example certain allergies or dietary requirements), and may become unsafe, unsuitable, or otherwise inappropriate.

ALL BOOKINGS ARE ONLY VALID ON SIGNING THE WAIVER HERE.

Payment Terms

A non-refundable deposit of CHF 500, (unless otherwise stated on the published retreat page), is payable at the time of booking to secure a place on the retreat.

The remaining balance must be paid in full at least 45 days prior to the retreat start date, unless otherwise agreed in writing.

For bookings made 45 days or less prior to the start of the retreat, all payments must be made in full.

Failure to pay within the required timeframe may result in forfeiture of the deposit and resale of the Participant’s place.

Late payments may incur a CHF 50 (or equivalent) fee.

Any early booking discounts only apply if full payment is received by the advertised deadline.

Bank, PayPal, or other transfer fees are the responsibility of the Participant to pay.

The Participant is responsible for paying for all services not included in the retreat package (e.g., travel, insurance, transfers, extra meals, spa services, or personal expenses).

Cancellations

By Participant

  • Cancellation more than 90 days before retreat start: refund of balance paid (minus the non-refundable deposit).

  • Cancellation 30–90 days before retreat start: 50% refund of balance (minus the non-refundable deposit).

  • Cancellation within 30 days of retreat start: no refund.

  • A client may agree to gift their place on the Retreat to a replacement client already known to the Organizer, refunds or transfers may be offered at the Organizer’s discretion, any of which will be confirmed in writing.

By Organizer

  • The Organizer reserves the right to cancel or reschedule the retreat due to insufficient enrollment, facilitator illness, venue issues, or force majeure (e.g., natural disaster, pandemic, government restrictions).

  • In such cases, Participants will receive a full refund of all amounts paid or credit toward a future retreat and / or product.

  • The Organizer is not responsible for additional costs incurred by the Participant, including flights, visas, insurance, or other travel-related expenses.

Liability

Participation in retreat activities (including yoga, movement, sound healing, meditation, breathwork, excursions, and outdoor experiences) is voluntary and at the Participant’s own risk.

The Participant acknowledges that such activities carry inherent risks and accepts full responsibility for their personal wellbeing and participation.

The Organizer, facilitators, and staff are not liable for injury, illness, property loss, or damages arising from participation.

The Organizer is not responsible for the Participant’s personal belongings during the retreat and during travel to and from the retreat.

Participants may be asked to sign an additional waiver and release of liability prior to their participation in the retreat.

Travel and Health Insurance

The Participant is solely responsible for arranging adequate travel, health, and cancellation insurance, which is a requirement of retreat participation.

Insurance should cover medical emergencies, illness, injury, trip cancellation, loss of property, and emergency evacuation and include relevant provisions for COVID.

The Participant affirms they are physically, mentally, and emotionally able to participate in retreat activities.

The Participant agrees to disclose all relevant medical conditions, allergies, or dietary needs in confidence and in advance so that the Organizer can provide reasonable accommodations.

Data Protection 

The Organizer will collect and process personal data (e.g., health, dietary, and contact information) solely for retreat planning and safety purposes.

Such data will be stored securely and shared only with staff or service providers who need it, unless required by law.

The Organizer complies with applicable data protection and privacy regulations.

Updating these terms of service

The Organizer reserves the right to amend or update these Terms & Conditions at any time. Updated terms will be communicated to registered participants and published online.

Continued participation following updates constitutes acceptance of the revised terms.
